Plaintiffs filed suit against the Government, alleging violations of their Fourth and Fifth Amendments and the Administrative Procedure Act, and seeking declaratory and injunctive relief. Plaintiffs' action stemmed from extensive and intrusive security screenings at domestic and international airports, and their belief that they were on a terrorist watchlist maintained by the U.S. Government. The district court granted the Government's motion to dismiss with prejudice on the ground that plaintiffs lacked Article III standing.The DC Circuit concluded that because plaintiffs plausibly allege that they will travel again soon and that they will again endure the alleged illegalities, they have established an imminent threat of future injury and have standing to pursue most of their claims for prospective relief. The court could easily infer from the family's travel history that they will soon fly again, particularly if they secure the relief they now seek. Furthermore, plaintiffs' uncontested factual allegations, combined with the reasonable inferences the court drew from them, plausibly indicate that the family likely appeared on a terrorist watchlist in 2018. The court also concluded that plaintiffs plausibly allege that the treatment they endured went well beyond what typical travelers reasonably expect during airport screenings. Finally, plaintiffs' factual allegations lead to the reasonable inference that the family's watchlist status remains the same today.However, the court held that plaintiffs lack standing to pursue prospective relief relating to certain actions taken by Government agents who detained them during their travel in 2018. In this case, plaintiffs claim that these actions violated established federal policies, but they lack standing because they have not plausibly alleged any impending or substantial risk of future harm. The Texas Workers' Compensation Act (TWCA), Tex. Lab. Code 401.007–419.007, regulates the prices that insurers must pay to providers for various medical services utilized by their beneficiaries, including air transport services. However, those price restrictions conflict with the federal Airline Deregulation Act (ADA), which makes clear that the states "may not enact or enforce a law, regulation, or other provision . . . related to a price, route, or service of an air carrier that may provide air transportation under this subpart." 49 U.S.C. 41713(b)(1).The Fifth Circuit joined its sister circuits, which have unanimously held that the ADA preempts state price caps on air ambulance reimbursements, and that those state price caps are not saved by the McCarran–Ferguson Act. The court disagreed with the Texas Supreme Court, which has reached contrary conclusions by a divided vote. Therefore, in this case, the court affirmed the judgment and held that the TWCA regulations concerning the reimbursement of air ambulance providers like Air Evac are preempted by the ADA, and are not saved by the McCarran–Ferguson Act. At issue in this case are two provisions of North Dakota Senate Bill 2231. The first prohibits air ambulance providers from directly billing out-of-network insured patients for any amount not paid for by their insurers (the payment provision). The second prohibits air ambulance providers or their agents from selling subscription agreements (the subscription provision).Guardian Flight filed a declaratory judgment action claiming that both provisions are preempted under the Airlines Deregulation Act (ADA). Defendants responded that, even if preempted, the provisions were saved under the McCarran-Ferguson Act. The district court concluded that although the ADA preempted both provisions, the McCarran-Ferguson Act saved the subscription provision.The Eighth Circuit agreed with the district court's ADA preemption analysis and concluded that the ADA preempts both the payment provision and the subscription provision. However, the court held that the McCarran-Ferguson Act does not apply because the provisions were not enacted "for the purpose of regulating the business of insurance." In 1999, the Taylors purchased land near a New Mexico Air Force base to raise calves. The Air Force began flying training missions over the land, sometimes “no more than 20 feet . . . off the deck.” In 2008, the Taylors granted Wind Energy an exclusive five-year option for an easement on the Taylors’ property, for “wind resource evaluation, wind energy development, energy transmission and related wind energy development uses.” In 2012, Air Force employees suggested to Wind Energy that the FAA would not issue a “No Hazard” designation for the air space above the Taylors’ land, which would be “fatal to the construction of planned wind turbines.” Wind Energy exercised its contractual right to terminate the agreement.The Taylors sued, claiming that the Air Force’s informal advice to Wind Energy caused a regulatory taking of their property interest in their contract and that the flyovers effected a physical taking. The Federal Circuit affirmed the dismissal of the complaint. Wind Energy’s termination was not a breach of the agreement so the Taylors had no property right in the continuation of that agreement nor did they have any investment-backed expectations. Any advice given by Air Force employees did not amount to an FAA denial. Plaintiffs filed suit challenging both their inclusion on the No Fly List and the sufficiency of the procedures available for contesting their inclusion on the list. The Ninth Circuit affirmed the district court's grant of summary judgment for the government and held that the district court properly rejected plaintiffs' as-applied vagueness challenges. The panel held that the No Fly List criteria are not impermissibly vague merely because they require a prediction of future criminal conduct or because they do not delineate what factors are relevant to that determination. Rather, the criteria are reasonably clear in their application to the specific conduct alleged in this case, which includes, for one or more plaintiffs, associating with and financing terrorists, training with militant groups overseas, and advocating terrorist violence.The panel weighed the Mathews v. Eldridge factors and held that the procedures provided to the plaintiffs were constitutionally sufficient and any error was nonprejudicial. Finally, the panel held that the district court properly dismissed plaintiffs' substantive due process claims for lack of jurisdiction under 49 U.S.C. 46110(a), which places review of TSA orders in the courts of appeals rather than the district court. Exhaustless petitioned for review of the FAA's latest interim orders limiting the number of flights serving LaGuardia and John F. Kennedy Airports in New York and seeking implementation of Exhaustless's patent-pending product to manage the allocation of takeoff and landing slots to airlines.The DC Circuit dismissed the petitions based on lack of standing, holding that the company failed to demonstrate that vacating the interim FAA orders would redress its injury—i.e., a lack of market opportunity for its product. Furthermore, vacating the interim orders would leave takeoffs and landings at the airports unregulated, eliminating the need for the company's product at the federal level. To the extent that Exhaustless argued that the local airport authority could employ its product if there were no federal regulation, the court found any such possibility too speculative to support standing. Petitioner brought a third challenge to the TSA's airport scanner equipment using advanced imaging technology (AIT). Petitioner challenged the TSA's latest policies and orders that require certain airline passengers to pass through AIT scanners, eliminating for them the option of being screened by a physical pat-down.The Eleventh Circuit held that it was without jurisdiction to entertain petitioner's claims, because petitioner lacked the necessary standing to bring the petition. The court held that petitioner failed to establish that he suffered an injury in fact, that is, the invasion of a judicially cognizable interest that is concrete and particularized and actual and imminent. In this case, petitioner has never said that he was subjected to the mandatory TSA policy, before his petition or since then, even though he has made numerous filings since he lodged his petition for review containing substantial information about his travel patterns and his interactions with TSA. Tweed, seeking to expand its primary runway, filed suit to invalidate a Connecticut statute that had limited the runway's length. As a preliminary matter, the Second Circuit held that Tweed had Article III standing because it established an injury in fact, the injury was caused by the Runway Statute, and a favorable decision will likely redress Tweed's fear of the statute's enforcement. The court joined the Fifth and Tenth Circuits in holding that a subdivision may sue its state under the Supremacy Clause. Therefore, Tweed, as a political subdivision of Connecticut, may bring suit against Connecticut.On the merits, the court held that the Runway Statute was preempted by the Federal Aviation Act where the Act's preemption applies to airport runways and the Runway Statute falls within the scope of that preemption. Furthermore, Congress intended the Act to occupy the entire field of air safety including runway length. Accordingly, the court reversed and remanded for entry of judgment in favor of Tweed. Defendants-Appellees Air Methods Corporation and Rocky Mountain Holdings, LLC provide air ambulance services. Defendants provided air ambulance services to Plaintiffs-Appellants, or in some cases to their minor children. Plaintiffs dispute their obligation to pay the full amounts charged by Defendants because Plaintiffs claim to have never agreed with Defendants on a price for their services. Plaintiffs filed suit, asserting jurisdiction under the Class Action Fairness Act, 28 U.S.C. 1332(d), to determine what, if any, amounts they owe Defendants. Plaintiffs also sought to recover any excess payments already made to Defendants. Defendants moved to dismiss, arguing that Plaintiffs’ claims were pre-empted by the Airline Deregulation Act (ADA), 49 U.S.C. 41713. The district court agreed and dismissed Plaintiffs’ claims with prejudice. The Tenth Circuit affirmed the district court’s dismissal of all Plaintiffs’ breach of implied contract claims, the Scarlett Plaintiffs’ declaratory judgment claim, all Plaintiffs’ unjust enrichment claims, and the Scarlett Plaintiffs’ due process claims; the Court reversed the district court’s dismissal of the Cowen Plaintiffs’ declaratory judgment claim, only with respect to the existence of contracts between the Cowen Plaintiffs and Defendants; and the Court remanded for further proceedings. In 2016, commercial air pilot Sean Fitzgerald showed up for work "rip-roaring drunk." He was set to fly in the morning, so he readied the jet for take-off: he conducted a walk-around safety check before entering the cockpit, where he calibrated the altimeter, programmed the flight-management system, turned on the auxiliary power unit, and requested flight clearance from air- traffic control. Before passengers boarded, Fitzgerald’s co-pilot recognized his inebriation and alerted airline executives, who in turn notified local law enforcement. Fitzgerald was arrested and charged under 18 U.S.C. 342, which makes it a crime to operate a common carrier while intoxicated. A jury convicted Fitzgerald, and the district court sentenced him to one year and one day in prison and to three years of supervised release. On appeal, Fitzgerald contended that the actions he performed were not enough to operate the aircraft within the meaning of section 342, that the jury was wrongly instructed, and that the district court erred at his sentencing. Finding no reversible error, the Sixth Circuit affirmed Fitzgerald's conviction. View "United States v. Fitzgerald" on Justia Law
