United States v. Yanjun Xu
Yanjun Xu, a Chinese citizen and member of China’s Ministry of State Security, was convicted of conspiracy to commit economic espionage and conspiracy to steal trade secrets from multiple aviation companies over a five-year period. Xu was also convicted of attempted economic espionage by theft or fraud and attempted theft of composite fan-blade technology from GE Aviation. He was sentenced to a combined 240 months’ imprisonment. Xu appealed, seeking to vacate the judgment and remand for a new trial, arguing that the district court erred in failing to dismiss Counts 1 and 2 as duplicitous and abused its discretion in admitting expert testimony in violation of Federal Rule of Evidence 704(b). United States v. Santonastaso
The defendant, Antonio Santonastaso, was convicted of making a false statement to federal investigators and attempted witness tampering. The charges stemmed from a 2018 investigation by the Federal Aviation Administration (FAA) into allegations that Santonastaso was flying a helicopter without the necessary certifications. During the investigation, Santonastaso falsely claimed that he had the requisite certifications to fly and that his previous involvement in a 2000 helicopter theft was part of an undercover operation.The case was first heard in the United States District Court for the District of Massachusetts, where Santonastaso was found guilty. FEJES V. FAA
The case involves James Fejes, a pilot who held a certificate issued by the Federal Aviation Administration (FAA) under 49 U.S.C. § 44703. Fejes used his aircraft to transport and distribute marijuana to retail stores within Alaska, an activity that is legal under state law but illegal under federal law. After an investigation, the FAA revoked Fejes's pilot certificate under 49 U.S.C. § 44710(b)(2), which mandates revocation when a pilot knowingly uses an aircraft for an activity punishable by more than a year's imprisonment under a federal or state controlled substance law.Fejes appealed the FAA's decision to an Administrative Law Judge (ALJ), who affirmed the revocation. He then appealed the ALJ's decision to the National Transportation Safety Board (NTSB), which also affirmed the ALJ. Throughout the agency proceedings, Fejes admitted that he piloted an aircraft to distribute marijuana within Alaska, but argued that his conduct fell outside of § 44710(b)(2)'s reach.The United States Court of Appeals for the Ninth Circuit denied Fejes's petition for review of the NTSB's order affirming the FAA's revocation of his pilot certificate. The court rejected Fejes's argument that the FAA lacked jurisdiction to revoke his pilot certificate because Congress cannot authorize an administrative agency to regulate purely intrastate commerce like marijuana delivery within Alaska. The court held that airspace is a channel of commerce squarely within congressional authority, and therefore, Congress can regulate Fejes's conduct. The court also rejected Fejes's argument that his conduct was exempt under FAA regulation 14 C.F.R. § 91.19, and that the FAA misinterpreted § 44710(b)(2). The court concluded that the FAA's revocation of Fejes's pilot certificate was not arbitrary, capricious, an abuse of discretion, or otherwise not in accordance with law. View "FEJES V. Daulatzai v. Maryland
In this case, the plaintiff, Anila Daulatzai, was removed from a Southwest Airlines flight after the captain received information about her dog allergy and the presence of two dogs on board. Daulatzai insisted on remaining in her seat despite the captain’s decision, leading to her physical removal by Maryland Transportation Authority police officers. She was later charged with various offenses, including disorderly conduct and resisting arrest.Daulatzai filed an action against Southwest Airlines and the State of Maryland, alleging various grounds to challenge her removal from the plane and her arrest. The district court dismissed Daulatzai’s complaint for failure to state a plausible claim upon which relief could be granted. Daulatzai appealed that judgment and, while her appeal was pending, she also filed a motion in the district court under Federal Rule of Civil Procedure 60(b), seeking to file a fourth version of her complaint with the district court.The court denied her request, finding that her efforts were pursued in bad faith, that her repeated failures to cure defects in her pleadings had been prejudicial to the defendants, and that the fourth complaint would, in any event, be futile. Daulatzai appealed that ruling as well.The United States Court of Appeals for the Fourth Circuit affirmed the district court's decision, finding that Daulatzai had failed to establish any of the grounds for relief under Rule 60(b) and that the district court did not abuse its discretion in denying Daulatzai leave to file her proposed third amended complaint. The court also found that Daulatzai had waived her challenge to the district court’s dismissal of her second amended complaint by failing to preserve it below.

United States v. Fitzgerald
In 2016, commercial air pilot Sean Fitzgerald showed up for work "rip-roaring drunk." He was set to fly in the morning, so he readied the jet for take-off: he conducted a walk-around safety check before entering the cockpit, where he calibrated the altimeter, programmed the flight-management system, turned on the auxiliary power unit, and requested flight clearance from air- traffic control. Before passengers boarded, Fitzgerald’s co-pilot recognized his inebriation and alerted airline executives, who in turn notified local law enforcement. Fitzgerald was arrested and charged under 18 U.S.C. 342, which makes it a crime to operate a common carrier while intoxicated. A jury convicted Fitzgerald, and the district court sentenced him to one year and one day in prison and to three years of supervised release. On appeal, Fitzgerald contended that the actions he performed were not enough to operate the aircraft within the meaning of section 342, that the jury was wrongly instructed, and that the district court erred at his sentencing. United States v. St. Amour
The Eleventh Circuit affirmed defendant's conviction for operating an aircraft with an unapproved fuel system in violation of 49 U.S.C. 46306(b)(9). The court rejected defendant's contention that the term "operates an aircraft" covers actions during or imminent to flight. The court held that both the United States Code and the Code of Federal Regulations — and clarified through the decisions of the Civil Aeronautics Board and the National Transportation Safety Board — that the term "operate" encompasses the refueling of an aircraft for the purpose of flight. In this case, defendant started the engine of the aircraft and taxied to a maintenance hangar where he refueled the aircraft to prepare for a flight the next day. Therefore, defendant operated the aircraft within the meaning of section 46306(b)(9) when he started, taxied, and fueled the aircraft in preparation for the first of his flights on the voyage to Paraguay. Defendant Joseph Lynch, II was a first-class passenger on a flight from Philadelphia to Denver. Defendant had consumed at least six beers prior to boarding, and began behaving in a loud, unruly manner once the flight was underway. He repeatedly placed his hands on first-class flight attendant’s lower back as she was serving him beverages, which made her feel “very uncomfortable,” and she tried to move out of his reach each time. Flight attendants refused to serve defendant any more alcohol during the flight, at which point defendant became “irate” and started shouting obscenities to the cabin crew. Defendant was arrested upon landing; while in custody, he continued shouting expletives. A jury found Defendant guilty of violating 49 U.S.C. 46504, which prohibits the in-flight assault or intimidation of a flight crew member or flight attendant that interferes with his or her duties. He received a sentence of four months, followed by a three-year term of supervised release. On appeal, Defendant challenged the district court’s interpretation of the statute, the constitutionality of the statute, and the length of his sentence. After reviewing the district court’s sentencing decision, the Tenth Circuit found no evidence of error and affirmed defendant’s conviction and sentence. View "United States v. Lynch" on Justia Law

United States v. Kumar
Kumar was 19 years old and in his first year in the Aviation Technology Program at Bowling Green State University when he was assigned to fly alone from Wood County Airport near Bowling Green to Burke Lakefront Airport in Cleveland, and back, after 10:00 p.m. The flight plan required him to fly over part of Lake Erie. On the return trip, Kumar observed what he believed to be a flare rising from a boat. He reported this sighting to Cleveland Hopkins International Airport and was instructed to fly lower for a closer look. Kumar could not then see a boat. Fearful of hurting his chances of one day becoming a Coast Guard pilot, he reported that he saw additional flares and described a 25-foot fishing vessel with four people aboard wearing life jackets with strobe lights activated. Kumar’s report prompted a massive search and rescue mission by the U.S. Coast Guard, and the Canadian Armed Forces. A month later, Kumar admitted that his report had been false. He pleaded guilty to making a false distress call, a class D felony per 14 U.S.C. 88(c)(1), which imposes liability for all costs the Coast Guard incurs. He was sentenced to a prison term of three months and ordered to pay restitution of $277,257.70 to the Coast Guard, and $211,750.00 to the Canadian Armed Forces. The Sixth Circuit affirmed. Heinemann v. Satterberg
After plaintiff was criminally charged, plaintiff filed a civil action against United Airlines in state court, alleging that its personnel falsified police reports, falsely diagnosed an epileptic seizure, and threatened him with an ice mallet, among other things. United removed the case to district court on the basis of diversity jurisdiction. The court granted United's motion for summary judgment. Plaintiff then filed the present action against defendant, the Prosecuting Attorney of King County, contending that he had no jurisdiction to file a criminal complaint against plaintiff. Defendant moved for summary judgment, plaintiff did not file any response, and the district court granted the motion. Plaintiff did not file anything further in the district court, and, instead, filed this appeal to the court. The court agreed with plaintiff that, under the Federal Rules, a motion for summary judgment could not be granted based on a failure to file an opposition to the motion, regardless of any local rule that suggested the contrary. However, on the merits, the court affirmed the grant of summary judgment where defendant was entitled to summary judgment based on any of his three arguments presented in his motion.
